Terms and Conditions
1. Overview
Welcome to Cheffy (“Cheffy”, “we”, “us”, “our”). Cheffy is an online marketplace connecting independent home chefs (“Home Chefs”) with customers (“you”, “users”) who wish to purchase home-cooked meals, attend supper clubs, or join cooking workshops.
By accessing or using our website, you agree to these Terms of Use (“Terms”). Please read them carefully.
If you do not agree, you must not use our website or services.
2. Nature of the Platform
Marketplace model: Cheffy provides a digital platform for independent Home Chefs to list and sell food and related services. Unless expressly stated, Cheffy acts only as a facilitator.
No agency: Except where Cheffy expressly provides food or services itself, the contract for food or services is between the Home Chef and the customer.
Cheffy’s role: Cheffy provides payment, booking and communication tools, but does not control or guarantee the quality, safety, legality or availability of the food or events.
3. Eligibility
You must be at least 18 years old to use the website.
By registering, you warrant that all information provided is accurate and complete.
If you act on behalf of a business or organisation, you represent that you are authorised to bind that entity.
4. Your Account
Keep your login details confidential. You are responsible for all activity under your account.
Notify us immediately if you suspect unauthorised access.
We may suspend or terminate accounts for breach, misuse or unlawful conduct.
5. Ordering and Payment
All orders are subject to confirmation and availability.
Prices are shown in AUD and include GST (where applicable).
Payment is processed via secure third-party gateways; Cheffy does not store full payment details.
A booking or order is confirmed only once payment has cleared.
You authorise Cheffy (or its payment provider) to debit your chosen method of payment for the total amount displayed at checkout.
6. Home Chef Obligations
Home Chefs must:
Hold all required food-business registrations, permits and insurances applicable in their state or territory;
Comply with all food safety, hygiene and labelling laws;
Ensure allergen disclosure and proper storage/transport;
Indemnify Cheffy for any loss or claim arising from their breach of law, negligence or unsafe food handling.
Cheffy may require evidence of compliance and reserves the right to suspend or remove non-compliant Home Chefs.
7. Consumer Obligations
Customers must:
Read all meal/event descriptions carefully before ordering;
Disclose relevant allergies or dietary requirements directly to the Home Chef before purchase;
Collect or receive meals promptly and store/consume them safely.
Cheffy is not responsible for health issues arising from consumption of food prepared by independent Home Chefs.
8. Cancellations & Refunds
See our Refund & Cancellation Policy (incorporated by reference).
9. Intellectual Property
All site content, design and trademarks are owned by or licensed to Cheffy.
You may not copy, reproduce, distribute or modify content without prior written consent.
User-generated content (reviews, photos) remains yours, but by posting you grant Cheffy a worldwide, royalty-free licence to use and display it on the platform and promotional materials.
10. Prohibited Conduct
You must not:
Use the website for any unlawful, fraudulent or harmful purpose;
Post defamatory, misleading or offensive content;
Interfere with or disrupt the website, servers or networks;
Circumvent payment systems or communicate off-platform for unapproved transactions.
11. Liability & Consumer Guarantees
Nothing in these Terms excludes, restricts or modifies any Consumer Guarantee under the Australian Consumer Law (ACL).
To the extent permitted by law, Cheffy excludes all other warranties.
Where services are not of acceptable quality or fail to meet a Consumer Guarantee, your remedies are limited (at Cheffy’s option) to re-supply or refund.
Cheffy is not liable for indirect or consequential loss (including illness, loss of profits or data).
12. Indemnity
You agree to indemnify Cheffy and its officers, employees and contractors against any loss, damage, liability, cost or expense arising from your breach of these Terms or unlawful use of the platform.
13. Termination
We may suspend or terminate your access at any time for breach or misuse.
Clauses relating to intellectual property, liability, indemnity and governing law survive termination.
14. Governing Law
These Terms are governed by the laws of Victoria and the Commonwealth of Australia.
You submit to the non-exclusive jurisdiction of those courts.
15. Amendments
We may update these Terms from time to time. The revised version will be posted on this site with a new effective date. Continued use of the website constitutes acceptance.
